LANDSCAPING:

• The workmanship provided for a one-year period from the date of project completion. Guarantee will be null and void if the customer has not kept to the original payment terms. Due to the seasonal nature of our business, guaranteed repairs will be completed between March 15th and October 31st only. All requests made after October 15th will be done the following year.

CURBING

• The workmanship provided for a two-year period from the date of project completion. Separation, heaving, and workmanship are the only things covered under warranty. Damage caused by weather or other natural occurrences is not covered. Guarantee will be null and void if the customer has not kept to the original payment terms. Due to the seasonal nature of our business, guaranteed repairs will be completed between March 15th and October 31st only. All requests made after October 15th will be done the following year.

EXCLUSIONS FROM GUARANTEE:

• Due to the nature of materials Miles Lawn & Landscaping, LLC cannot guarantee materials from warping, sagging, cracking, chipping or becoming loose. Periodic maintenance may be required by the customer.

• Scheduled dates are approximate.  Miles Lawn & Landscaping, LLC. and cannot be held responsible for any and all delays that are beyond our control.
• Changes made by the customer will result in a delay. All monies for materials and labor incurred by Miles Lawn & Landscaping, LLC become due and payable.
• The landscaping area must be clearly outlined and marked by the customer. This is the sole responsibility of the customer. While Miles Lawn & Landscaping, LLC will make every effort to ensure landscaping is installed as required by the customer. It accepts no responsibility whatsoever for the inaccuracy of the area of installation and/or construction of landscaping, nor any liability arising directly or indirectly out of the installation and/or construction of landscaping.
• Any additions, substitutions, or changes to the original scope of work, materials, quantities, design, or product selections requested by the customer after the quote has been approved will require a written Change Order. The Change Order will outline any additional material, labor, equipment, delivery, or disposal costs and must be approved by the customer before the additional work is performed. Changes may also affect the project schedule and completion date. Verbal requests do not alter the original contract and do not waive the customer’s responsibility for additional charges.
• The customer agrees to assume, pay and accept all responsibilities for any claim arising from damage caused to underground cables, sprinklers, easements, conduits, or pipes of any kind marked or unmarked in the installation and/or extraction of landscaping.
• Miles Lawn & Landscaping, LLC is not responsible for animals/pets’ conditions or whereabouts before, during, and after the landscaping project.
• The customer represents to Miles Lawn & Landscaping, LLC that he/she is the owner of the real property or authorized to hire, provide directive, and is authorized to permit employees or agents of Miles Lawn & Landscaping, LLC to enter on the real property and complete the landscaping project.
• Miles Lawn & Landscaping, LLC shall not be responsible in any way for any bodily injury or damage to property arising from landscaping and is not responsible for natural damage to landscaping while building or after completion due to wind, rain, hail, vandalism or acts of God.
• Customer will be responsible for obtaining building permits if required.
• Ownership of materials shall remain with Miles Lawn & Landscaping, LLC until all amounts due for the project are paid in full.
• Miles Lawn & Landscaping, LLC has the right to substitute the materials specified with equivalent or superior products.
• Quotes are good for 30 days and are subject to change without notice. Work will start within 3 months of the date the downpayment is received.
• Customer agrees and accepts that Miles Lawn & Landscaping, LLC will not grant discounts or credits for any delays.
• If for any reasons beyond Miles Lawn & Landscaping, LLC’s control, Miles Lawn & Landscaping, LLC is unable to complete the work as contracted, the customer shall pay the balance due as calculated for work completed.
• Customer is financially responsible for cancellation and/or 30% restocking fee if the customer elects to cancel the contract for any given reason. Special orders will not be refunded.

• To secure a place on the installation schedule, Miles Lawn & Landscaping, LLC requires a 50% down payment within two weeks after signing of quote. Customer will have 50% remaining balance paid in full no later than 2 weeks after the completion date. If the balance is not paid in full 2 weeks after completion customer will be assessed $15 finance charge each month on the remaining balance each month until the balance is paid in full.
• The customer will have 3 months from the completion date to have the account paid in full. In the event, that the balance is not paid in full at that time and no payment arrangements have been made then the account will be turned over to a collection agency. The customer will be responsible for all additional charges and fees incurred by a collection agency or other outside parties as a result of default in payment. Miles Lawn & Landscaping, LLC reserves the right to file a mechanics lien against the property for any unpaid balance in accordance with the Nebraska law.
• Should the customer default or fail to comply with any of the terms hereof, or become bankrupt or insolvent, sell or dispose of the lands on which said landscaping is established. The unpaid balance will immediately become due and payable.
• All returned and/or unpaid checks will be charged an additional $35.00 NSF fee.
